Conservative Girl Adventures - Doctor Defending Obamacare



Yesterday while I was out and about I ran into a doctor that I know casually. He is a general practitioner who is in favor of the law that was signed today. His list of reasons included:



Medicare is losing money by not paying for wellness exams. By paying for these exams they can find things at an earlier stage when it is both easier to treat and less expensive. Ok, I think we can all agree this is a good thing. But, it didn’t take almost 3,000 pages to accomplish this.


His bottom line will increase. As a person in favor of capitalism I am ok with that. He writes off tens of thousands of dollars that he is never paid for. Here we have a bit of a disagreement. When I was sick my issues were not really my treatments, but my prescription costs. I didn’t understand that had I called the pharmaceutical company they could have helped me work out a more reasonable rate. I also must be a complete idiot, as I paid back every dime of debt. Apparently most people can’t be bothered. I made arrangements to pay an affordable amount every month. It took me years, but it was paid. I don’t understand why people don’t pay their debts. I know firsthand that if you work with the doctors, they will work with you. Now, I am not saying there are times that people just can't do it.  That absolutely happens.  Again, we can put in safety nets for this.


He told me that he is forced to increase the costs of the insured to cover the under-payments for services from Medicare. Medicare is scheduled to be decreased, not increased. This problem will still exist and may actually get worse as the baby boomers hit retirement age.


I asked him if I came into his office and paid cash in full at the time of visit would this decrease his costs. He said that it would require less administrative time which would lower his overhead costs. So I asked doesn’t it stand to reason that if we move away from insurance dependence instead of increasing it costs would be lowered? He said that would lower staff costs. He currently has five people who do nothing but fill out paperwork for insurance companies. This has been proven to lower costs at Safeway, Whole Foods, and the state employees of Indiana. I have a similar plan. I have a high deductible that is supplemented by a HSA. Once my HSA runs out I then use my insurance. This has been very cost effective for me. Almost all HSA’s will now pay doctors directly, so they will be paid the same way that they are right now by conventional insurance.


My final questions were to ask him if he accepted Medicaid. He does not. So we are increasing the role of Medicaid into the healthcare system, who is going to treat them? What we have done is given people access to insurance. This will not translate to improved health. For improved health wouldn’t they actually have to have access to a doctor? His response was that it is not perfect. Really?


Lastly, and there is no way around this, if I am wrong, so what? My bad, I’ll take responsibility for it, and the country will be better off. If he is wrong, what then? The most innovative medical care in the world could be destroyed. Who is going to be responsible for that?

Some Observations of Last Night at the Capitol


As I spent last night with fellow tea partiers down at the Capitol Building I couldn't help but make a few observations:

There truly are some crazy people out there.  There were some Obama fans there, as well as the Catholics for Social Justice.  Now, they are Americans and have every right to be there too, that isn't my issue.  One of them must have forgotten to take her lithium last night.  She was running after me and telling me that I had no soul.  She believes that this travesty is the right thing to do, I get that.  I don't understand it, but I get it.  But, why she believes that I don't have a soul is beyond me.  She also was telling people that she is a doctor that has a 30 year old daughter that doesn't have any insurance.  Excuse me, but if you are doctor can't you afford to help your daughter out for a while and get her insurance?  Doctors make a decent living, she should be able to help out her daughter while she is uninsured.  She this is the difference, I believe that you help your own, she believes that the government should be doing it for you. 

It was hard to tell exactly who was for and who was against, as not everyone was carrying signs making it obvious where they stood.  I got into a conversation with someone who obviously was part of the vote yes crowd.  At one point he was telling me everything that was wrong with conservative Christians, and at least Catholics have a intermediary between people and God.  Fundmentalists, he said, believe that God speaks through them.  Why he felt the need to tell me this I am not sure.  We also did talk about points of the bill, well sort of.  Of course Bush was brought up, the Iraq war, and the usual talking points.  I told him that is a child's answer and it has to stop being made about party and talked about by what is right for all Americans.  If we keep up this tit for tat problems will never be solved.  He firmly believes that anything the CBO says is 100% correct.  Hmm, I wonder if that is true if it were a republican bill that he doesn't like?  See, I don't trust the CBO to be correct on anything as they are limited to what they can use, and the government always spends more money than they say they are going to. 

The signs for "do this for Uncle Teddy" made an appearance. 

The La Raza people came and joined us at one point.  One was wearing a T-shirt that said, Undocumented and Not Hiding.  Interesting that one would choose to wear that on the property of the Capitol, but they are correct that they have nothing to fear from this administration. 

Just before the vote, I had to use the ladies room.  While I was walking down the hallway I ran into Congressman Paul.  Well, his office was open and I went in.  He told me that America was committing suicide tonight, and it would pass  because the democrat majority was too high and they couldn't stop it.  He had to go and vote so I didn't get the chance to ask if he believed that we could repeal this or leave it unfunded until a new president is elected. 

Congressman King is a good man.  He kept coming out and telling us what was going on.  After the vote he came down to the side lawn where we were and talked to all of us in person.  Michele Bachmann also came and talked to us and explained to us what the next steps that the republicans would be taking. 

As much as I don't like the woman's politics, I have to admit that Pelosi is a savvy politican.

Update On Kill the Bill Rally - March 20



Updated Location for Saturday Code Red Rally



The location for the Rally has been changed to the West Lawn of the Capitol. The expected size of the event has grown, thereby necessitating this change!


Some people are also planning to meet at 10am to visit Congressional offices; however, I know on previous rally days on Saturdays, most Congressional offices have been closed. Further, it looks like many of the Congressmen have purposefully been doing everything in their power to ignore the people; so I am skeptical that any of the swing offices will be open. Nonetheless, if you have the time; you are free to see if anyone is in on Saturday.


The main rally starts at noon and the candlelight vigil starts at 6 (which seems early for candlelight to me, but I didn't pick the time). I believe the vigil will be in the Upper Senate Park, but I have not seen an official statement on this.

Slaughter Rule Vote



The Republicans forced a floor vote today in regards to the Slaughter Rule. 

Some points of interest:

Jason Altmire, PA-D, who will not committ to anything at this point voted no to disallow the use of the Slaughter Rule.  I think this speaks volumes of where he really stands.  He just doesn't have the courage to say so.  Grow a spine Altmire.

The upmost in hypocrisy I think comes from Stephen Lynch of MA and Luis Gutierrez of Il, who are publicly saying they are against the bill.  This will allow them the wiggle room of saying they were against the senate bill and all of it's bribery, yet still vote for it.  They have clearly drunk the kool-aid that the American public is stupid enough to buy that. 

Democrat Yes votes:

Virginia Rep. Tom Perriello, who voted for the House bill, voted against party leaders.


Perriello was joined by fellow "yes" votes Michael Arcuri of New York, Kathy Dahlkemper of Pennsylvania and Gabrielle Giffords of Arizona. Michigan Rep. Bart Stupak, who voted for the first House bill also, voted against his leadership, along with Pennsylvania Rep. Chris Carney and Illinois Reps. Jerry Costello and Daniel Lipinski. Tennessee Rep. Jim Cooper and Maine Rep. Mike Michaud also joined the Democrats voting with Republicans.

More Bad News for Romneycare - Something to Look Forward to (Not)

Romneycare is one of the few models we have to look at as a guide to Obamacare.  More results are in, and they aren't good. 

Per capita spending is 27% higher than the national average

Massachusetts Medical Society has stated that there is a "critical shortage" of primary care doctors

56% of internists will no longer be accepting new patients

If you are able to find a doctor, the average wait time is 44 days.  (I have never waited 44 days to see any doctor, except as all women know, your gynocologist)

Emergency room visits have increased 7% between 05 and 07

More than 50% of those visits were not emergencies

75% of the major insurance carriers in the state had operating losses for 2009

More than 50% of the people who are newly insuranced, pay nothing for the coverage.  The system was set up that everyone would pay something towards the costs. 

The state mandates for insurance coverage cost more than $1 billion per year.  People think that our rising costs are due to lack of government oversight, but this study proves the rising costs are due, at least in part, by the government oversight

Studies in the state have found that having insurance doesn't give you access to healthcare, having access to doctor is what gives you healthcare:

Health Care Reform and The Iraq War - The New Republic's Connection



William Gaston of The New Republic did an OP-ED Piece the other day how the President is doing the right thing by moving forward with health care reform even though the majority of the public is against it. He is comparing President Bush moving forward with the surge strategy in Iraq as his justification. I have to give it to him, this is the first time I have heard this comparison.



“With the passage of time,” former Bush administration official Pete Wehner writes today, “President Bush’s decision to champion a new counterinsurgency strategy, including sending 30,000 additional troops to Iraq when most Americans were bone-weary of the war, will be seen as one of the most impressive and important acts of political courage in our lifetime.”


I was always on the fence about the war. I am not normally one not to have a strong opinion, but in this case I did not. On one hand, Saddam was a terrible man who no problem committing mass murder, as he did with the Kurds. Call me crazy, but I don’t think that sociopaths should be heads-of-state. The other side of that argument is it the job of The United States to deal with? I remember telling someone that I was working with at the time that I was not sure that we should be making a ten year commitment to a country in The Middle East, that it would be used as yet another recruiting tool for al Qaeda. I had always believed we would need to be there for a minimum of ten years. The country didn’t have the proper infrastructure to set up a democratic type government and that would take time to create.


I was especially unhappy to learn how badly it was bungled by Donald Rumsfeld. At the beginning of the Bush administration one of the goals had been to make our military smaller and more nimble. Then 9/11 happened. Whatever the plans were to make changes to how the military was going to run should have been put on hold. Rumsfeld tried to accomplish both goals at once. It did not work. He tried to fight Iraq on the cheap and the Bush presidency never really recovered. The surge was the right thing to do because it was our moral obligation to fix what we broke. We went in without the proper plan for the aftermath and did not make the necessary adjustments once we saw what was happening on the ground. The surge was done to give the country some stability in order to move forward with developing a government that will work for that country, and it also lessened the bloodshed.


To compare the health care reform bill to a war is just incredulous to me. His believe is that President Obama is simply working in the interests of the US people like President Bush did with the surge. I have always believed that President Bush truly believed that Saddam was a direct threat to the US. After 9/11, he believed his mission was to protect and defend the US homeland, which is part of the oath he took when sworn into office. The reality is he was wrong. Saddam was “contained” as the Europeans said during the run up to the war. At the end of the day, his intentions were good, but that doesn’t change the facts. Although, I recently read that yellowcake was found in Iraq and transferred to Canada. The AP reported it once after the transfer was complete, and it was never really talked about again, as the lame stream media never picked up the story. If that is the case, then maybe I would have to change my assessment.


I too believe that President Obama does believe that his health care reform bill is the right thing to do for the country. He believes it to his core, I don’t doubt that. What I doubt is that “reform” bill will actually help the underlying problems. Just because the President believes it, doesn’t make him right.

Danny Williams, the Premier of Newfoundland and Labrador, needs heart surgery.  A surgery that is not available to him in his home province.  So where does he go?  No one is sure which medical facility he is in, but it is indeed in the United States of America.

My question is, where are the Canadians going to go if we make our system like theirs?

Hey Mary, You Went Cheap - Nebraska Will Never Pay for Medicaid

Ben Nelson got the sweetest of sweetheart deals. The State of Nebraska will never pay for Medicaid. The 49 other states will pick up the tab. Is there a person out there that is not outraged?



The democrats have obviously made a decision that they don't care how many seats they lose next year as long as this passes. Pelosi will only lose her seat if someone more far left runs against her, so I guess she is in the clear.  So what the heck, she will retain her seat and she will get rid of the moderate side of her party.  All that will be left is the far left people from the far left districts around the country.  This may not bode well for Barbara Boxer, after all, what did she get for California? 


The arrogance that this portrays is stunning, simply stunning. Every poll across the country has shown that the American people do not want this bill to be passed.



I think pitchforks are necessary. The democratic leaders of this country have really reached an all time low. Bribery, blatant falsehoods, and total lack of concern for the people that are paying their salaries seem to be the order of the day. 1/6 of our economy is on the line and no one has read the bill. They have no idea if it is actually going to work.


This is a sad day for America, a very sad day indeed.

10th Ammendment and HealthCare - CBO Report




Hey Speaker, this is why people are asking if this bill is unconstitutional. 

In addition, the bill would preempt state and local laws that conflict with or are in addition to new federal standards established by the bill. Those preemptions would limit the application of state and local laws, but CBO estimates that they would not impose significant costs.


As conditions of federal assistance (and thus not mandates as defined in UMRA), the bill also would require state and local governments to offer health insurance to their employees and would require “maintenance of effort” payments associated with high-risk pools. New requirements in the Medicaid program also would result in an increase in state spending.

Nancy Pelosi, Blue Dogs and You




Today, the big news is that Nancy Pelosi does not have the votes in the house to pass healthcare legislation that contains a public option. The speaker is in a bit of a conundrum. She has publicly stated on many occasions that passing legislation that does not contain a public option is out of the question as far as she is concerned. The blue dog dems have made their impact and have stayed together; they are saying no way, no how.



The real irony to this story is the fact that Speaker Pelosi has created this situation herself. After the 2004 loss of John Kerry, she devised a plan to consolidate power in the house. In order to do this, the party made a concerted effort to go out and find moderate democrats to run in districts that lean more conservative. Her plan worked beautifully, until now.


In 2006, the gains that were made by the democrats gave the democrats control of the house and gave her the speakership. That lead was increased in 2008. The republicans got their clocks cleaned and her power was further consolidated.


The speaker is trying to foist her extreme left wing views on the rest of the country and fully expected her compatriots to go along. I am sure that she is thinking to herself, I helped get you elected and you owe me. So far they are staying true to the job that they were elected to do, represent the people from their districts; not give Speaker Pelosi everything that she asks for. Conservative leaning districts don’t want government run healthcare.


A large part of this good news to conservatives has to do with you. All the people who showed up at town halls, and have written letters, sent e-mails, and have gone to tea parties made the difference. Keep up the good work. If we keep the pressure up, we may just be able to get real healthcare reform, not the dribble that they are trying to pass off as reform.

A Constitutional View of HR 3200





Constitutional Lawyer critiques Health Care Reform (HR 3200)











by Michael Connelly of Carrollton, Texas, retired Constitutional Lawyer, having read the entire health care bill (HR3200), has some comments, not about the bill, but about the effects on our Constitution. It's a broader picture than just health care reform.






THE TRUTH ABOUT THE HEALTH CARE BILLS






Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, Constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.






To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.






The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled. However, as scary as all of that it, it just scratches the surface.






In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead, it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.






The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.






This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures.






You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.






If you decide not to have healthcare insurance or if you have private insurance that is not deemed "acceptable" to the "Health Choices Administrator" appointed by Obama there will be a tax imposed on you. It is called a "tax" instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the "due process of law.






So, there are three of those pesky amendments that the far left hate so much out of the original ten in the Bill of Rights that are effectively nullified by this law. It doesn't stop there though.






The 9th Amendment that provides: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." The 10th Amendment states: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people." Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.






I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation" to support the Constitution. If I was a member of Congress, I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

Here is some interesting information on then Senator Obama's votes regarding healthcare reform.


Throughout his years in the U.S. Senate, Barack Obama joined Democrats to defeat meaningful health care reform proposals that would have helped to solve many of the problems he now says can only be addressed by a $2-trillion government takeover.

A sampling of Sen. Obama’s greatest NAY’s below:

NO on Allowing Americans to Deduct Their Health Care Costs. S. Con. Res. 70 (110th Congress, 2nd Session, Roll Call 82).
The Senate rejected an effort to allow for an above-the-line federal income tax deduction for individuals who do not receive health insurance through their employers. The amendment offered by Sen. DeMint (R-SC) failed on March 13, 2008 by a vote of 45-51.

NO on Allowing Americans the Freedom to Purchase Health Insurance Across State Lines. H.R. 976 (110th Congress, 1st Session, Roll Call 305). The Senate rejected an effort to allow Americans to purchase individual health insurance across state lines. The amendment offered by Sen. DeMint (R-SC) failed on August 2, 2007 by a vote of 37-62.

NO on Allowing Americans to Use Their OWN HSA Funds to Cover Health Insurance Premiums. H.R. 2 (110th Congress, 1st Session, Roll Call 26). The Senate rejected an effort to allow Americans to use their tax-free Health Savings Account funds to purchase health insurance. The amendment offered by Sen. Ensign (R-NV) failed on January 25, 2007 by a vote of 47-48.

NO on Preventing the Erosion of Private Health Coverage. S.Amdt. 2537 to S.Amdt. 2530 to H.R. 976 (110th Congress, Session 1, Roll Call 299)The Senate rejected an effort to minimize the erosion of private health coverage. The amendment offered by Sen. Kyl (R-AZ) failed on August 2, 2007 by a vote of 37-62.

NO on Expanding Access to Small Business Health Plans. On Motion to Invoke Cloture on the Committee Amendment (110th Congress, Session 2, Roll Call 119). The Senate rejected an effort to allow for the expansion of health care access and reduced costs through the creation of small business health plans and through modernization of the health insurance marketplace on May 11, 2006 by a vote of 55-32.

NO on Preserving Employer-Sponsored Coverage. S.Amdt. 2596 to S.Amdt. 2530 to H.R. 976 (110th Congress, Session 1, Roll Call 301)The Senate rejected an effort that would require individuals who are eligible for SCHIP and employer-sponsored coverage to use the employer-sponsored coverage instead of SCHIP. The amendment offered by Sen. Vitter (R-LA) failed on August 2, 2007 by a vote of 35-64.

NO on Requiring Health Insurance for Illegal Immigrants. S. 1348 (110th Congress, 1st Session, Roll Call 188). The Senate rejected an effort to require illegal immigrants seeking “Z Visas” to maintain a minimum level of health coverage. The amendment offered by Sen. DeMint (R-SC) failed on June 6, 2007 by a vote of 43-55.
