The lawsuit that was filed in Florida representing more than half of the states ruled in favor of the plaintiffs. The decision was much longer than the one from Virginia, this is 78 pages. This specifically goes to the heart of the matter about the individual mandate. The judge stated:
“Everyone must participate in the food market… under this logic, Congress could [mandate] that every adult purchase and consume wheat bread daily.”
This is something that conservatives have been saying since day one. If the government can do this they can do anything. The reality is it doesn't matter that this bill happens to be about healthcare, because if this is allowed to stand anything can be forced upon the American people through the commerce clause. It is a very dangerous and slippery slope into a totalitarian government. I am not one to buy into conspiracy theories or I rarely buy into overly vitriolic statements that Obama is trying to turn the US into the Soviet Union. But, this bill gives someone who does the perfect opportunity to do so. It is an over-reach and a violations of our individual rights. Does healthcare need reform? No doubt about it. Do we need to do more to help the working class poor to get proper coverage? Yes. This law is not the way to do it unless you are willing to give up your liberties. Sorry, Nanny and Uncle Obammy, I am not. Lets get to work and pass some laws that will actually solve the problems without giving away our freedoms.
If you need an argument that the left can understand, Ken Cuccinelli put it best. Imagine the uproar on the left in this country if every person was mandated to buy and keep guns in order to maintain control and protection of the state. This is no different, it is just about healthcare, an issue that too easily manipulated to get sympathy and pull at the heart strings. No one should die because they can't afford a doctor. No one is saying that they should. But, as Americans we have rights. Those rights must be protected. This law cannot stand, and today we took a big step in seeing that happen.

Really, the fact that you passed a law that violates our consitutional rights isn't odd and over-reaching, but the courts calling you out on it is? That is how I define odd.
This young woman wants to sue the mall for releasing this video. Why I agree that the mall security people shouldn't have released this, but it certainly doesn't rise to the level of a lawsuit. You can't see who she is, so how exactly was she damaged? No one would have known who she was had she not gone public. Also, do you really have an expectation of privacy when walking through a mall? Everyone is out to make a buck on something that they themselves are responsible for. We wonder why our legal system is so backlogged.
She should have been paying attention to where she was going. It is no one else's fault but her own. Buck up girl, and BTW it is funny.
As you may know, Virginia was the first state to file a lawsuit against the healthcare law. Attorney General Ken Cuccinelli has been very vocal about his constitutional objections to the law that mandates that all Americans purchase healthcare insurance. The federal government has filed a motion to dismiss the case. This will be heard on July 1st. If the motion is not granted it will go to court around October.

I am writing you tonight to make sure you know of an important development in Virginia's case against the federal healthcare law. Today, Virginia filed its brief in opposition to the federal government's attempt to dismiss Virginia’s lawsuit against the new federal healthcare law.
While it's over two months since we first filed this suit - in legal terms, this case is moving at a lightning pace!
The US responded to our lawsuit with a motion to dismiss the case - which we fully expected.
Below is a simple but thorough chart which identifies the US's arguments in the case, and explains our response to each one. I would encourage all of you to take a look - and let me know your thoughts!
The U.S. has to file its reply brief by June 22nd, and then the oral arguments on the motion to dismiss will take place on July 1st at 10 a.m. - one hour for each side.
If Virginia's case is not dismissed and moves forward, a summary judgment hearing is scheduled for October 18th.

AG's website, but the first line gets right to a counter to the US’s sickly view of federalism: “In the view of Secretary Sebelius, federalism is so withered and near death that States lack the power and right to go to federal court to test the validity of their own enactments when they conflict with federal law.”

Federal government's arguments to dismiss the case ("Fed Args"), followed by Virginia's response ("Va Response"):
Fed Arg: Virginia is not injured by the federal health care law
Va Response: Because the federal health care law purports to invalidate a Virginia law (the Health Care Freedom Act) under the Constitution's Supremacy Clause, Virginia's sovereign interests have been injured.
Fed Arg: Because the mandate doesn't take effect until 2014, the case is not "ripe"
Va Response: 1) Based on several previous Supreme Court decisions, if a dispute is certain to occur in the future, this does not prohibit the suit from being brought in the present
2) Virginia has already been forced to make decisions regarding insurance exchanges under the act, as well as changes to Medicaid. One of those decisions made the commonwealth forego more than $100 million in federal money.
Fed Arg: Virginia's suit is barred by the Anti-Injunction Act.
Va Response: The act does not apply to states under these circumstances, because Virginia's action falls within an exception to the act that has been recognized by the Supreme Court
Fed Arg: The government has the power under the Constitution's Commerce Clause to mandate the purchase of individual health insurance
Va Response: 1) The federal government's argument is contrary to the text of the Constitution
2) The federal government's argument is contrary to the meaning of the words of the Commerce Clause as understood by the Founders
3) The federal government's argument is contrary to the historical context of the nation's founding. When Great Britain instituted a tax on tea, the colonists' response was to boycott and to not buy tea. Parliament had the power to regulate commerce, but even it did not attempt to force colonists to buy the taxed product.
4) The federal government's argument is contrary to the traditional uses of the Commerce Clause. The clause has always been used to regulate economic activity; never inactivity.
5) The federal government's argument is contrary to the precedent of the U.S. Supreme Court. The Court has set outer limits to the reaches of the Commerce Clause, including in cases such as Lopez and Morrison, saying that the clause must have principled limits, otherwise the federal government essentially would have unlimited power, rather than the limited powers enumerated in the Constitution.
Fed Arg: Even if refusing to buy insurance is not commerce, the government can still force people to buy health insurance using the Constitution's Necessary and Proper Clause.
Va Response: 1) Since 1819, the Supreme Court has held that any use of the Necessary and Proper Clause must be consistent with both "the letter and spirit" of the Constitution. Any interpretation that would destroy the federal form of government (where federal power is limited only to those powers enumerated in the Constitution, with remaining powers reserved to the states and the people) is not allowed under that standard.
2) In May, the Supreme Court decided Comstock.
The Court adopted a historical approach to the use of the Necessary and Proper Clause. Because the mandate is utterly unprecedented, it is unlikely to be upheld under a historical approach.
Fed Arg: Even if the government cannot win using the Commerce Clause and Necessary and Proper Clause arguments, the federal health insurance mandate can be justified under the government's taxing authority.
Va Response: 1) The penalty for not buying insurance is not a tax. Congress called it a "penalty" and claimed authority to act only under the Commerce Clause. To argue otherwise now ignores what Congress actually did.
2) A penalty for inaction is not a tax of any kind known to the Constitution, when judged historically.
